Ready to claim?
The truth about 'no win, no fee'
Q15 Does a solicitor need to be involved in my claim?
Yes, a solicitor will become involved at some point. We do not recommend that you deal with your claim by yourself.
‘… mistakes can be costly. By selecting specialist support you will … ensure the best chance of realising the full value of your claim’Why? Quite simply because this can be a complex area and mistakes can be costly. By selecting specialist support you will be protected from making mistakes or the consequences of them, and ensure the best chance of realising the full value of your claim.
This is where specialist negotiating skills can really count. Insurance companies are very experienced in dealing with personal injury claims and will, not unreasonably, do what they can, within the law, to keep the level of payout to a minimum. For example, it sometimes happens that an offer of compensation is made by the defendant’s insurance company at an early stage that is below what might be expected if the case were allowed to go to court.
There are some important issues to bear in mind in respect of a solicitor's involvement. First, a solicitor is bound by a code of conduct regulated by the Law Society.
‘… a good personal injury claims specialist will use his expertise to direct you to a solicitor who is expert in injury claims of your type’Second, your injury may have aspects to it that require the services of a solicitor who has a very specific specialist expertise. Of course, you can approach a solicitor you know that has the required expertise, but what if you don’t know of one?
This is one of the reasons why it is sensible to consider approaching a personal injury claims specialist first. A personal injury claims specialist who meets the ClaimsGuide recommended criteria will make an initial assessment of your position and will, as in all cases where he believes there is a reasonable chance of success, use his expertise to direct you to a solicitor who is expert in your type of injury claim.
